Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://beachbumssupport.com/ website and BeachBums mobile application (the "Service") operated by JC Trident, Inc. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Account Creation

If you wish to use the Service, you must consent to either creating your own account or link it to an existing Facebook account.

Location Services

If you wish to use certain functions within BeachBums (including modifying beaches, searching, discovering, etc…), you have to enable location tracking while using BeachBums. This allows for full functionality within the application. Location tracking is limited to use in the app. 

Accuracy of Information Provided

The Service relies on users providing accurate and up to date information within the functions of Updating Beaches, Discovering Beaches, and Recommendations. By accepting these Terms, you are stating that you are providing information that is accurate to the best of your knowledge. 

When Discovering a Beach within the application, you are responsible for providing comprehensive information about the discovered beach including: the accurate name of the beach, the correct location (user has ability to pin the exact location), a picture of said location, and a brief description. When adding the “Description” you are not allowed to use any language that could be deemed offensive or flagrant. You will also be asked to provide information about parking, bathrooms, fishing, pets, showers, and the basic information required about the beach. By agreeing to these terms you are stating that you will make a reasonable effort to ensure you add the necessary and accurate information.

In order to “Update” a beach, you must be located within 3 kilometers of the pinned location of a beach. When you “Update” the information, you have a responsibility to provide accurate and current information that is demanded of BeachBums.

Similarly, when answering “Recommendations” you are doing so with the expectation of providing an accurate and relevant answer to the proposed question.

Recommendations

The “Recommendations” function is designed to provide a platform to ask questions that would enhance a user’s enjoyment of a particular location. This function is meant to give users the ability to ask questions about an area that other users that have a greater knowledge of that area can answer. We do not recommend users share contact information, personal information, or information about their location in this function. If BeachBums becomes aware of such information being requested or shared within the application, we will take the necessary action of removing the offending information and reserve the right to remove users from the Service. 

Additionally, when you are creating and responding to recommendation requests, you must use appropriate language.

Verification Process

We have the ability to review items added to the application including users, beaches, and modifications. Before Discovered Beaches are added to the app we have the right and ability to modify, confirm, or deny beaches deemed inaccurate or that are duplicates of prior beaches. Should we deem an update to the app as inaccurate, then we reserve the right to deny adding the beach. Repeated offenses of inaccurate updates can bring a suspension or deletion of the offending account. 

Violation of the Terms & Conditions

In using the Service you agree to comply with the Terms. Violation of the Terms can result in the following penalties. 

· Warnings issued by BeachBums.

· Suspension of the offending parties account.

· Deletion of the offending parties account.

· Potential legal action should the offending parties actions result in litigation against JC Trident, Inc.

We maintain the right to use any of the above penalties necessary based upon the level of offense done by the offending party.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by JC Trident, Inc.

JC Trident, Inc has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree JC Trident, Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
